Our Chapter 7 Bankruptcy Practice
In a Chapter 7 bankruptcy proceeding, you may be allowed to permanently discharge certain debts. Under the recent revisions to bankruptcy laws, you must now qualify to file under Chapter 7 by demonstrating to the court that you lack the means to repay your creditors over a 3 to 5 year period.
When you hire us to help you with a personal bankruptcy filing, we will first determine if you are eligible for protection under Chapter 7. We will review all factors the court considers under the "means test."
If you qualify, we will prepare and file all the documentation required to initiate and complete your Chapter 7 bankruptcy filing. We will also appear on your behalf in all meetings with creditors, the bankruptcy trustee, and the court.
Our Chapter 13 Bankruptcy Practice
If you fail to qualify for a Chapter 7 bankruptcy proceeding or you choose to repay your creditors, we will help you reorganize your debt in a Chapter 13 filing. In this process, you set up payment plans with your creditors, paying off all debt usually within 3 to 5 years.
We will help you put together a plan of reorganization to submit to your creditors. We will also review any proposed debt restructuring plans from your creditors.
